Arbitration

  At the Company’s sole discretion, it may require you to submit any disputes arising from the use of these Terms of Use, any product or advice, or the Website, including without limitation disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Expedited Commercial Rules of Arbitration of the American Arbitration Association applying Georgia law to be held in Lawrenceville, Georgia in a proceeding with a single arbitrator. Judgment on any arbitration award may be enforced by any court of competent jurisdiction.

Limitation on Time to File Claims

  ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE, ANY PRODUCT, ADVICE OR SERVICE, OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Terms of Sale

These Terms of Sale (collectively, “TOS”) are between the Company (together with our officers, members, managers, employees, independent contractors and agents) and you. These TOS apply to all goods you order or we provide to you (“products”) and any information, recommendations, or services that we may provide to you (“advice”), whether through the Website or otherwise.

  1. Orders and Products

. We accept your orders for product by an email confirmation containing all terms of shipment and sale not already stated in these TOS. Unless you timely notify us of any error in a confirmation, its terms are binding. We stand behind our products. If any product is not acceptable to you, for any reason, notify us in writing within ten (10) business days from your receipt and include a description of the affected product and your reason for rejecting it. Failure to so notify shall constitute acceptance of the products. If you do so notify us, we will choose one of the following: a. to replace or issue a credit for (equal to the product price) of the product being rejected, so long as it is returned to us in saleable condition or b. to repair the product, if possible. All product is shipped FOB from our fulfilment facility in Lawrenceville, Georgia by common carrier. You have title and risk of loss upon our delivery of products to the carrier. The parties entered into these TOS in reliance upon the all the provisions in this paragraph 4, which reflect an allocation of risk between the parties (including the risk that a contract remedy may fail of its essential purpose and cause consequential loss), and that the same form an essential basis of the bargain between the parties.
